GENERAL

  1. These Terms and Conditions outline and govern the travel services rendered by Mount Kinabalu Climb, as well as the related responsibilities and liabilities.
  2. Submitting the booking request form online or through email will be taken as an agreement to the Booking Terms and Conditions and Payment Methods by the Client (the person mentioned in the Booking Enquiry Form, and their companions). This is an assurance that the Client has the authority to act on behalf of the persons listed in the Booking Enquiry Form for the travel and tour services.
  3. The purchase or booking of Mount Kinabalu Climb's travel services establishes a contractual agreement between you and Mount Kinabalu Climb. This also implies your acceptance of the Terms and Condition of Mount Kinabalu Climb.
  4. All ascents offered by Mount Kinabalu Climb are billed in Malaysian Ringgit (MYR) and are only valid for the validity period specified.

RESERVATION PROCEDURE

  1. For online instant bookings, a complete online payment is mandatory and upon successful payment, an immediate confirmation of the reservation will be automatically generated.
  2. Reservations for non-instant and offline bookings can only be guaranteed for 2-3 days from the date of the client invoice issuance, unless specified otherwise.
  3. Advance Reservations (Bookings made more than 45 days in advance of tour date)
    • 40% deposit payment is required to secure standard climb slots/ accommodation/ tours/ all other bookings.
    • 50% deposit is required to secure Via Ferrata climb slots/ accommodation/ tours/ all other bookings.
    • 60% balance payment is required 45 days prior to tour commencement.
  4. Last Minute Reservations (Bookings made within 45 days of tour date) 100% full payment is required to secure climb slots/ accommodation/ tours/ all other bookings and admission to the tour, for last minute reservation made within 45 days prior to tour commencement. If the conditions are not met, your reservation may be automatically cancelled and your climbing slots, accommodation, tours, and any other bookings may be made available to others without notice. The availability of all bookings will be determined at the time of booking. Full payment is necessary for purchase of airfares.

MODES OF PAYMENT

  1. The tour prices are quoted in Malaysian Ringgit (MYR).
  2. Payment via bank-in/telegraphic transfer to our Malaysian bank account in Malaysian Ringgit (MYR).
  3. Payment via visa/master credit card in Malaysian Ringgit (MYR) only. A 3% Admin Fee applies.
  4. Payment can be made in cash, check, or interbank fund transfer (with the client responsible for any administrative bank charges). The exchange rate is determined by MountKinabaluClimb.com and payments should be deposited into the designated company bank account and the bank-in (TT) slip should be sent to us via fax or email. Credit card payments using VISA or MASTERCARD can also be processed via a secured payment web link sent to your email address.

CANCELLATION POLICY

  1. A written notice must be given by the client if he or she wishes to opt for cancellation.
  2. Number of days between tour commencement and receipt of cancellation notice:
    • 30 days or more (40% of tour cost forfeited)
    • 15 to 29 days (75% of tour cost forfeited)
    • 08 to 14 days (85% of tour cost forfeited)
    • 04 to 07 days (95% of tour cost forfeited)
    • Less than 04 days or No Show (100% of tour cost forfeited)
  3. For tour products or individual components supplied by the third-party service providers, such as airfare and accommodation reservations, cancellation fees as outlined in the vendor's terms and conditions will be applied in addition to a minimum handling fee of MYR50 per service per individual.

REFUND

  1. Mount Kinabalu Climb renders services according to itineraries. Therefore, no refunds will be issued for unutilized lodging, meals, tours, transportation, or other services.
  2. No refunds will be given for the Mount Kinabalu Climb Packages regardless of bad weather, natural disasters, being refused by Sabah Parks rangers or mountain guides due to your health and safety issues, personal reasons, flight cancellations, or any other reason.
  3. The absence of a climber on the day of departure is considered a no-show. There will be no refunds.
  4. Mount Kinabalu Climb will not handle any refund request until we receive a completed Refund Details Acknowledgement Form from the guest.

TRAVEL DOCUMENTS / PASSPORT / VISA

  1. All passports and visas must be valid for a minimum of six months from the date of arrival into the destination country.
  2. It is the clients’ duty to verify the passport and visa requirements, as well as any other immigration needs with the relevant Embassies and/or Consulates. Mount Kinabalu Climb is only able to provide general information regarding these topics.
  3. The client must ensure that he or she possesses the relevant travel documents, vaccinations, and health certifications as stipulated by the various authorities of the destination countries.
  4. Client is obligated to keep his or her own passport and other key travel documents while travelling. Mount Kinabalu Climb is not responsible if the client loses his or her passport for any reason.
  5. Mount Kinabalu Climb is not responsible for any fee, reimbursement, or refund in the event that a client is denied entrance into the destination country by immigration officials for any reason.

FORCE MAJEURE

Mount Kinabalu Climb shall not be held responsible or be liable to pay any compensation for any disruption of services due to events classified as "force majeure". Force majeure is any event that affects a pre-arranged climb which we or the other providers (if applicable) could not, despite taking all precautionary measures, anticipate or avoid. These events may include war, civil unrest, terrorism, industrial disputes, natural disasters, epidemics, pandemics, quarantine, fire, floods, explosions, compliance with laws and regulations, strikes, lockouts and any other cause beyond our control. Mount Kinabalu Climb reserves the right to cancel, change, or reschedule a tour impacted by force majeure, and shall not be liable for any direct or indirect consequences of the cancellation, amendment, or rescheduling.

RISK AND SPECIAL ASSISTANCE

  1. For special dietary requests, Mount Kinabalu Climb will do its best to accommodate them, but cannot guarantee that the requests will always be met. If meals are served buffet/set menu style, we suggest you not to include meat or other items that you do not eat.
  2. It is the client’s responsibility to inform us prior to the booking about any physical or mental health issues, disabilities, pregnancy, or other issues which may present a health hazard to themselves or others or require medical attention or special care. We will do our best to meet your needs, but you must notify us when you book in order to figure out what help we can reasonably offer.
  3. Mount Kinabalu Climb has the authority to deny acceptance of any person who is not physically fit enough for the climb, as it involves a considerable level of physical exertion.

LIABILITY

  1. Mount Kinabalu Climb disclaims any liability for any losses, harm, mishaps, illnesses, or changes in plans caused by weather conditions, strikes, natural disasters, pandemics, or any other uncontrollable circumstances.
  2. Mount Kinabalu Climb may need to adjust routes, itineraries, or departure times in the event of an unforeseen occurrence. If so, arrangements of similar standard will be substituted.
  3. Therefore, we highly suggest that all our customers to obtain comprehensive travel insurance to cover any eventualities.

PERSONAL TRAVEL INSURANCE

  1. All clients are strongly urged to get comprehensive personal travel insurance to guard against any unexpected events that may take place during the ascent.
  2. It is suggested to purchase travel insurance policies that provide protection for personal injury, death, medical and repatriation costs in the countries which you plan to visit, as well as insurance for loss of baggage and belongings, personal liability, delay, cancellation, curtailment, and missed departure.

CLIENT'S RESPONSIBILITIES

As our clients, you are responsible for:

  1. Verify the details of your Confirmation Invoice when you get it before carrying out any payments or transactions with Mount Kinabalu Climb. Should there be any discrepancy, you should alert us right away.
  2. Present yourself to take up of all the pre-booked components of your climb. If you do not show up due to personal reasons, no refund or compensation will be given.
  3. Respect the authority and abide by the instructions given by the mountain guide and the laws of the countries during your ascent.

THIRD PARTY SERVICE PROVIDERS

  1. Mount Kinabalu Climb works with hotels and other accommodation providers, coach companies, transfer operators, tour operators, local guides, activity providers, and other independent parties (Third Party Suppliers) to provide you with the pre-booked components. We make sure to select reliable Third-Party Suppliers, but we do not manage or influence their actions and thus cannot be held responsible for their actions.
  2. In the absence of our own negligence, we disclaim all liability for any cancellations, delays, diversions, or substitutions of equipment; loss or damage to luggage or other property; illness or injury; or any claims, losses, damages, costs, or expenses resulting from upset, disappointment, distress, or frustration, whether physical or mental, as a result of any act, omission, error, or negligence on the part of Third-Party Suppliers.
